Terms of Service
These Terms of Service set out the rules that govern your use of MasterCase Canada at mastercase.ca, your account, and your purchases of products through the marketplace. If anything is unclear, contact us at support@mastercase.ca.
ACCEPTANCE OF TERMS
These Terms of Service ("Terms") form a legally binding agreement between you and MasterCase Wholesale Inc. ("MasterCase Canada," "we," "us," or "our"), a company incorporated in British Columbia, Canada, operating the marketplace at mastercase.ca.
By creating an account, placing an order, or otherwise using the MasterCase Canada platform, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them.
If you are purchasing on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.
We will present these Terms clearly before you complete any purchase and ask for your affirmative acceptance. If you do not agree to these Terms, do not use the platform.
THE MASTERCASE CANADA PLATFORM
MasterCase Canada is an online marketplace that connects independent Canadian vendors ("Vendors") with consumers who wish to purchase Canadian products by the case ("Consumers"). MasterCase Canada provides the platform, payment processing infrastructure, and logistics coordination. MasterCase Canada is not the Vendor or seller of any product listed on the platform.
Each product on MasterCase Canada is listed and sold by an independent Vendor. The Vendor is responsible for the product's quality, safety, compliance with applicable laws, accurate description, and shipment. When you purchase a product on MasterCase Canada, your purchase contract for that product is with the Vendor, not with MasterCase Canada.
MasterCase Canada earns a commission on each transaction. This commission is included in the price you pay — it is not an additional fee charged to you.
INFORMATION WE DISCLOSE BEFORE YOU PURCHASE
In accordance with BC, Ontario, and Quebec consumer protection legislation, we disclose the following information before you complete your purchase:
- Seller identity: The name and province of the Vendor are displayed on each product listing page and confirmed in your order confirmation.
- Product description: Each product page includes the product name, description, case size, quantity per case, and unit specifications.
- Total price: The total price you pay — including the product price, applicable taxes (GST/HST/PST by province, calculated at checkout), and any shipping charges — is displayed in full at checkout before you confirm your order. No additional fees will be added after you confirm your purchase.
- Delivery timeframe: Vendors are required to ship within 3 business days of order placement. Estimated delivery windows are displayed at checkout based on the vendor's province and your delivery address.
- Payment method: We accept major credit cards (Visa, Mastercard, American Express) and Shop Pay. Payments are processed by Stripe Inc.
- Cancellation and return policy: See our Return Policy and the Cancellations, Returns, and Refunds section below.

A copy of your order confirmation, including all of the above information, will be sent to your registered email address within minutes of purchase. This serves as your written contract record for the purposes of BC's Business Practices and Consumer Protection Act and the Quebec Consumer Protection Act.
CREATING AN ACCOUNT
To place an order, you must create an account with MasterCase Canada. You agree to:
- Provide accurate, current, and complete information when creating your account
- Keep your account information up to date
- Maintain the security and confidentiality of your password
- Notify us immediately at support@mastercase.ca if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account credentials
We reserve the right to suspend or terminate accounts that provide false information, engage in prohibited conduct, or are inactive for more than 3 years.
PRODUCTS — CASE QUANTITIES AND DESCRIPTIONS
All products on MasterCase Canada are sold by the case. The case size (e.g., "Case of 12 × 340g") is displayed prominently on each product listing. You are purchasing the full case, not individual units.
Product descriptions, images, and specifications are provided by the Vendor. MasterCase Canada reviews listings before approval but does not independently verify every product claim. If you receive a product that does not match its description, see the Cancellations, Returns, and Refunds section below.
Product availability is managed by each Vendor. Items may become unavailable after you begin the checkout process. If an item becomes unavailable after your payment is processed, we will contact you within 1 business day to arrange a full refund or substitute.
PRICING AND PAYMENT
Prices are displayed in Canadian dollars (CAD). The price displayed on the product listing page is the price per case before taxes and shipping.
At checkout, before you confirm your order, you will see:
- Itemized product price per case
- Shipping cost (if applicable)
- Applicable taxes (GST/HST and/or PST by your province)
- Total amount charged
No additional fees, surcharges, or processing fees are added after you confirm your purchase. The amount shown as "Total" at checkout is the exact amount charged to your payment method.
Payment is processed by Stripe Inc., a third-party payment processor. Your credit card number is encrypted and processed directly by Stripe. MasterCase Canada does not store your credit card number. By placing an order, you authorize us to charge your selected payment method for the total amount displayed at checkout.
SHIPPING AND DELIVERY
Products are shipped directly from the Vendor's facility to your delivery address. MasterCase Canada does not warehouse or handle any products.
Vendor fulfillment obligation: Vendors are required to ship your order within 3 business days of order placement. If a vendor fails to ship within this period, please contact us at support@mastercase.ca.
Shipping label: A pre-paid shipping label is automatically generated and sent to the vendor upon order confirmation. This process is automated — you do not need to take any action.
Tracking: You will receive an email with a tracking number and link once the vendor ships your order. You can also view live tracking status in your account under "My Orders."
Delivery timeframe: Estimated delivery windows are provided at checkout. Actual delivery may vary due to carrier delays, weather, or other factors outside our control. MasterCase Canada is not liable for carrier delays once a shipment is in transit with the carrier.
Non-delivery: If your order has not been delivered within 30 days of the confirmed ship date, you are entitled to cancel the order and receive a full refund. Contact us at support@mastercase.ca.
CANCELLATIONS, RETURNS, AND REFUNDS
Order Cancellations Before Shipment
You may cancel your order before the Vendor ships it. Contact us immediately at support@mastercase.ca with your order number. If we are able to stop the shipment, you will receive a full refund to your original payment method within 15 days. Once an order has been shipped, it cannot be cancelled.
Returns — Damaged, Defective, or Incorrect Items
Because products are sold directly from Vendors by the case, MasterCase Canada handles return requests on a case-by-case basis. You are entitled to a replacement or full refund if:
- Your order arrives damaged or defective
- The product received does not match the product description (wrong item, wrong size, wrong quantity)
- Your order is not delivered within 30 days of the confirmed ship date
To initiate a return or refund, contact us at support@mastercase.ca within 7 days of delivery (or within 7 days of the expected delivery date in the case of non-delivery). Include your order number, a description of the issue, and photographs if applicable.
We will respond within 2 business days and work with the Vendor to resolve your issue. Refunds are issued to your original payment method within 15 days of our confirmation that a refund is owed.
Change of Mind Returns
Because products are sold by the case in bulk quantities and shipped directly from Vendors, we are unable to accept returns for change of mind. Please review your order carefully before completing your purchase.
Quebec Residents — Additional Rights
If you are a Quebec resident, nothing in these Terms limits your rights under the Consumer Protection Act (Quebec), including your right to:
- Receive a written record of your contract within 15 days of purchase
- Cancel within 7 days if required contract information was not provided
- Receive products that are fit for their ordinary use, reasonably durable, and as described (these implied warranties cannot be waived)
- A full refund if goods are not delivered within 30 days of the agreed delivery date
MARKETPLACE RELATIONSHIP — VENDOR LIABILITY
MasterCase Canada operates as a marketplace facilitator. MasterCase Canada is not the manufacturer, distributor, or vendor of any product sold on the platform. Each Vendor is an independent business.
Each Vendor is required to:
- Ensure their products comply with all applicable Canadian federal and provincial laws, including the Canada Consumer Product Safety Act
- Accurately describe their products
- Fulfill orders within the required timeframe
- Carry product liability insurance
If a product causes injury, property damage, or harm, your claim is primarily against the Vendor. MasterCase Canada's Vendor Agreement requires all Vendors to indemnify MasterCase Canada for product-related claims. MasterCase Canada will cooperate with you in asserting any claim against the Vendor.
PROHIBITED USES
You may not use the MasterCase Canada platform to:
- Submit false, fraudulent, or unauthorized orders
- Impersonate any person or entity
- Scrape, copy, reproduce, or systematically download platform content without written permission
- Interfere with or disrupt platform infrastructure or security
- Use the platform for any purpose that violates applicable Canadian federal or provincial law
- Post or transmit content that is defamatory, obscene, or infringes third-party intellectual property rights
- Resell products purchased on the platform commercially without prior written approval
We reserve the right to suspend or terminate your account if you engage in any prohibited use.
INTELLECTUAL PROPERTY
The MasterCase Canada name, logo, website design, software, and original content are the intellectual property of MasterCase Wholesale Inc. and are protected by Canadian copyright, trademark, and other intellectual property law. You may not reproduce, distribute, or create derivative works from any MasterCase Canada content without express written permission.
Product descriptions, images, and related content on vendor listings are owned by or licensed to the respective Vendors. MasterCase Canada does not claim ownership of Vendor-supplied content.
If you believe any content on the platform infringes your intellectual property rights, contact us at legal@mastercase.ca with a description of the alleged infringement and we will investigate promptly.
PRIVACY AND EMAIL COMMUNICATIONS
Your use of the platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully — it explains what personal information we collect, how we use it, and your rights.
By creating an account, you consent to receive transactional emails related to your orders (order confirmations, shipping notifications, delivery confirmations). These are not marketing emails and are necessary for the fulfillment of your order.
We will only send marketing or promotional emails if you have expressly opted in. You may unsubscribe from marketing emails at any time using the link in any such email.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW:
- MasterCase Canada's total liability to you for any claim arising from or related to these Terms or your use of the platform shall not exceed the total amount you paid for the specific order giving rise to the claim.
- MasterCase Canada is not liable for any indirect, consequential, incidental, special, or punitive damages, including lost profits, loss of data, or business interruption.
- MasterCase Canada is not liable for the acts, omissions, products, or services of independent Vendors.
- MasterCase Canada is not liable for carrier delays, loss, or damage to shipments once in transit with the carrier.
Nothing in these Terms limits MasterCase Canada's liability for: fraud or fraudulent misrepresentation; death or personal injury caused by our negligence; or any liability that cannot be excluded under applicable law. Nothing in these Terms limits your statutory rights under applicable provincial consumer protection legislation.
WARRANTIES AND REPRESENTATIONS
MasterCase Canada provides the platform on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
We do not make any warranty regarding the products sold by Vendors beyond what is expressly stated in the Vendor's product listing. Each Vendor is responsible for the accuracy of their product descriptions and the quality and safety of their products.
Quebec residents: Nothing in this section limits the implied warranties under the Quebec Consumer Protection Act (fitness for use, durability, as described), which apply to products sold through this platform and cannot be waived.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
We encourage you to contact us first at support@mastercase.ca to resolve any dispute informally. We will make reasonable efforts to resolve your concern within 15 business days.
If a dispute cannot be resolved informally, it shall be subject to the non-exclusive jurisdiction of the courts of British Columbia. You retain the right to pursue claims in the courts of your province of residence if you are a consumer.
Nothing in these Terms requires you to arbitrate a dispute or waive your right to participate in a class proceeding. These Terms do not include a mandatory arbitration clause or a class action waiver. Your provincial consumer protection rights are not affected by these Terms.
CHANGES TO THESE TERMS
We may update these Terms from time to time. If we make material changes, we will notify you by email at the address associated with your account and post a prominent notice on mastercase.ca at least 30 days before the changes take effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the updated Terms.
We will maintain a version history of these Terms. If you object to any changes, you may close your account before the effective date without penalty.
